That is just poor planning/design/implementation. Normally would at least have a triangular band of guard rail to divert vehicles to either side of the divider.

I’ve had a few BMW dealer loaners in the past year. Normal mode made me wonder why anyone would pay more for a new-ish BMW when they could buy something else for less. Eco and auto start/stop drove me insane. I daily a E70 diesel and the mode selector is my foot.
