You do realize that it’s not illegal to have a gun, right? Seeing a gun doesn’t mean that a crime is being committed.

Open carry is legal as long as the gun is in the holster. If you take it out of the holster and are not using it at that moment to defend yourself or someone else then you are breaking the law.

People that open carry, conceal carry, or carry in their cars are expected to alert police that they’re carrying a firearm (if they get stopped).

Whether or not he had a gun is irrelevant though, since North Carolina is an open carry state. 

So your argument here is that the 2nd Amendement to the US Constitution and North Carolina’s open cary laws legally allow for a gun to be holstered to ones body.... but never be held?
