If he has said something like, “I am pro-union. I don’t think a union makes sense for us. However, I support my co-workers right to determine if it is an avenue we should pursue.” That would be fine, However, it was in response and implicit support of his bosses threats against those who would seek unionization.

If everything is so hunky-dory then he should welcome the union talk and be confident that a no vote would prevail. What you cannot do is threaten folks who see to even pursue this option, whether or not it is eventually voted for not.
