there is a such rule you are talking about. however, there is channales on twitch and youtube that have nudity. they are just marked with 18+. there is no ban just a flagging of content.

its the publishers loss if there is no current "legal" copy of the game. if they did threw people in court for pirating this game, they would look really stupid in front of the judge. they should take this to court, no one can currently prove who has it and would be worth the legal costs.
