As has already been mentioned, code is covered under copyright. The issue I have with that is where do you draw the line? If I want to print "Hello, world." there are only so many ways to do that, and theoretically already covered by somebody else's copyright.

Since the Desktop arranges icons from the upper right by default, perhaps they wanted the image to have some empty space up there so it made it easier to see your icons. I've been known to flip pictures (or exclude them entirely from my desktop pic rotation) based on how it interacts with my desktop icons.
