Montoya is 39 this year. 2016 would put him at 41, the same Age Schumacher was when he tried to come back and failed after only being out of the car for a few years. Juan is no schumacher.
Juan actually dropped quite a bit of weight to get back an indycar. He's not back to his F1 weight, but he's definitely trimmer than he was.

This is professional racing in cars with fenders. There's no 13/13 rule, no "gentleman's agreement". It's not club racing, it's not the amateur series that was the ALMS. They were racing for the win on the last lap, What did you want him to do, give a point by?
