I read that headline as “Kendall Jenner Got Robbed of $200k By Jewel” and got irrationally excited.

Apparently if you spend 2 years promoting your religious bigotry people won’t believe you when you swear your order has nothing to do with bigotry. Who could have predicted?

In a nutshell, the ability to challenge unconstitutional or unlawful acts by the Federal Government is one of the judiciary’s most important powers. Without it, there are very few checks in place that can genuinely stop an unlawful decree from the President. At least, none with any kind of reasonable swiftness.

These aren’t state courts deciding the issue. They are federal courts. Federal trial courts are separated by state, but they aren’t state courts. This is the Federal Court for the District of Hawaii.

This is somewhat related, and extremely important.

So, there are a bunch of lower federal courts under the supreme (federal) court. If someone wants to contest a law, they go to their district court first (the law they are alleging causing harm has to spawn from a local case) and depending on rulings, it moves up from there. It’s just delicious. Giuliani may be single-handedly responsible for a large portion of the losses in court, and Miller is responsible for a small part of judges refusing to treat this new EO as different from the first EO.

He is such a fool. His words and the words of his supporters are directly coming back to haunt him in court. Hawaii’s TRO specifically quotes both Giuliani and Miller, and shows how fucking awful the administration is at legal strategy.

This is an excellent decision, because the judge decided on the basis of the Establishment Clause. Previous decisions had punted on that issue; the Ninth Circuit’s Order was decided on the basis of the due process clause.

If there’s one thing we’ve learned recently, elections should come with a 90 day, money back, full product replacement warranty.

There is no independent or objective evidence supporting the need for a travel ban. The intent seems to be clearly impermissible animus. National security and counter-terror experts are almost unprecedentedly unified against this terrible policy.
