There are no good guys, here. It’s 3 multi-billion dollar corporations fighting over who gets a cut of which part of a cash cow. The whole point of this lawsuit is because one of them wants to be exempt from the rules.

My understanding of why these things are usually so expensive is because they’re limited-run items made in Japan. You don’t get to take advantage of mass-manufacturing and cheap Chinese labor like most products.
Orrrr they’re taking action against a developer who flagrantly violated the terms of service. Epic’s selfish action has put its own developers in trouble. I’m sure they’re more than willing to fork out some cash to help them out.
It’s to be consistent... Apple has revoked Facebook’s apple developer accounts in the past for similar attempts at circumventing the garden. Obviously Facebook has accounts back, but there also wasn’t the attempt of forcing the issue by going to court over it.
