What's the problem? People can still play the game and re-download them after they are taken off the marketplace (at least on XBLA, don't know about PSN). Nobody is losing anything.

One part of me feels bad for those guys, but the on the other hand when you financially rely entirely on a platform that you no control or input in you're really putting all your eggs in a horribly woven basket.

I'm with Atomrocker, these are 360-tier ugly. I was fine with the PS3 cases, or something else demure. Having a vivid strong colour necessarily slapped on the top is really gonna clash with some game's covers. I'm imagining something exactly like this:
