Unless they open it up for everyone then it can definitely be seen as traffic shaping.
The only way it would not violate (1) and (2) would be if Riot allowed their network to be used for all content. It's a network designed for ultra low latency specifically for LoL. Do you think Riot would spend so much of its own cash to open the network to everyone? No. That's traffic shaping.
And as I've said elsewhere, this would be impossible with full implementation of Net Neutrality protocols.

Unfortunately this kind of thing really isn't all that uncommon. Not only is "news" organizations more than happy to run with a story like this, they will often misinterpret or exaggerate the findings themselves. It's one of the many reasons why popular science and actual science differ so dramatically.
