Well, this is a show that implied that an alien who is posing as the president had the authority to create an executive order to make other aliens citizens simply for revealing themselves, as if Congress needed to have no say in such a process.
But if the adoption was fraudulent, the whole underpinning of her citizenship falls apart.
There's also the question of how Kara qualified to vote, which might mean she admitted to voter fraud.
Nice of the episode to gloss over the fact that Supergirl utterly failed to save Air Force One and everyone on board it, save for Marsden, who only survived because she's an alien, which Supergirl wouldn't have known. How many cabinet members, top aides and press correspondents were on that plane who are now all dead…
So, as the "president" is barking orders at Alex to fire the cannon, her obvious response could have been to point out that as an alien born on another planet, Marsden is not legally president and thus has no actual authority to give any military orders, but I digress.
Given how fast and loose this show plays with its plot points, there are several ways to save her. The Time remnant trick would at least have the virtue of using Savitar's origin story against him.
