You’d also think Daniels’ lawyers would point out that the fact that Penn wasn’t charged actually goes to what Daniels was saying — that white men get away with this kind of thing, but black men are much less likely to.

Even then I think it’s counterproductive. If you want to poke fun at outrageous behavior, the most effective rhetorical device in my opinion is the occasional subtle joke — make the reader proud that he/she caught it.
