I think you're getting the accident rate and fatality rate confused. The fatality rate has dropped dramatically since the widespread availability of cell phones. The number of accidents per year in the same period has remained relatively flat, though on a population basis the rate has probably fallen slightly. Source.

I would guess that 24 mph is the threshold at which the accurate detection performance of the system falls below the level at which Lexus feels is sufficient to claim that it "works." Above those speeds, the system might work, for example, 92% of the time instead of 99%.

1) I think at least some of these systems are designed with an accelerator override - if you lift off and depress the gas again, it will cancel the braking action. (And if they aren't, such overrides might be coming)
