Most of the time you are correct, if they are contracted for distribution. If they are not, since per the article part of the work was never contracted and therefor not the ownership of Imagos, then it no longer falls under either fair use nor the distribution rights of Imagos.

Only if they are reviewing it specifically. If you are reviewing something and use content that is contracted to be part of that piece, like a section of a movie with licensed music, then you need to have a license to use that music or they owner of the music can come after you.
