There is no crushing lawsuit that can be won. An employer has the right to terminate employment with or without reason. Politics is just as valid a reason as stealing, in the eyes of the court.

The 1st Amendment doesn’t apply to the private sector. In most states, right to work allows employers to terminate employment with or without reason.

Prosecutions really pile on in case a convict can get a conviction overturned. Thats why you see sentences with life plus 30 on multiple charges. Even if the convict can win appeal of life, he still has to serve 30 years minimum.
