My explanation for this, which I've mentioned in a past review, is that Jacob knew Ben was lying but misled Richard about it. Jacob avoids direct contact with the Others because they are a vulnerability that MIB could use to manipulate and kill him. Ben is a decoy while Jacob conducts his candidate search elsewhere.
