Because such a case concerns a contractual obligation to binding arbitration, it's much more complex than a criminal trial. Admissibility isn't directly at issue. But the defense could argue contractual breach on behalf of the NBA in that their decision was based on an illegal recording.

I think the NBA might've shot itself in the dick (at least ethically, possibly also legally) when they did nothing in regards to his sworn testimony in the 2003 housing discrimination cases, but decided to act when a private conversation, recorded (possibly) illegally was posted to a tabloid site.
