That isn’t how the law worked. If it worked like you and the author (and the plaintiff attorney quoted) are proposing, every time a shop fucks up, it would be on the hook for actual damages as well as legal fees.

You are misapplying the term “unfair”. Am example of that would be charging customers for synthetic Mobil 1 oil then dumping in generic conventional oil out of a Mobil 1 tank.

Unfair in a legal sense is one side taking advantage of an informational asymetry. There are plenty of ways for mechanics to do this.
