Meaning the one who raped the 13yr old won't likely face any more charges (if they could prove he conspired to help rape the 14yr old they could maybe get him with something minor, but that's not likely.

Honestly, I think that's the way it should be. What he did shouldn't be considered statutory rape, because to me that charge implies the only issue was her age. She was just plain raped, and whether she's 14, 24 or 64 is irrelevant.
