CA law has protections for tenants who are victims of domestic abuse. It includes removing an abuser from the lease/home upon order of the court. A move out order can be presented to the landlord, and then the landlord would need to terminate the tenancy rights of the abuser.

Well, the thing about injunctions (preliminary, permanent, TROs, etc.) is that the standard requires the consideration of the public interest, as it is one of the factors to be weighed. Public interest often is public opinion, as it is in this case.

Not what you think. They’re talking about levels of scrutiny applied when considering whether something passes muster under the equal protection or due process clauses. Rational basis is generally the lowest level of review, but they were trying to argue this other even lower standard should be applied.
