@Kenny: EULA's have to be tried in court, which companies are extremely loathe to do. Largely because they put so much ridiculous tripe in them and typically strip you of so many rights that you can't legally be stripped of that any real scrutiny would probably cause them to be thrown out as unconscionable.

@GhostRaven: Pretty certain you can't take a modded 360 online. MS don't mess around with that, shortly before MW2 released they actually banned somewhere in the region of 1 million modded 360's from XBL. Yes, one million. Could still play singleplayer, but couldn't access Live.
