Trump would probably love to do so, but I believe he can only pardon those imprisoned by the federal government, not the state. Now I wonder how long it’ll be until he decides to have that changed.

As for why CPS didn’t move her kids to family members first, they usually (at least here in FL) try that first. But if family members are unwilling or unable to care for the kids, or are too far away, then foster care is unfortunately the next step.

I’m a Guardian ad Litem volunteer as well. It’s tough. Lack of transportation, lack of education, lack of family members (or financially and emotionally stable family members) to help out, make climbing out of the system and completing a treatment and case plan very difficult.

So...I was a Guardian ad Litem (volunteer advocate for the children in these cases) for years. Often, the parents would tell their friends and family members that the kids had been taken from them for just a “light” spanking, or that they had left their kids alone for “just a second” while they went next door.

I was also a GAL for years, and am in total agreement with your comment(s). And tragically, some of the parents won’t even give a moment of self-reflection to their children being removed from their care.

I’m not going to take the position that the system is perfect or even good. But I’ve worked in it as a guardian ad litem and I promise you that for a lot of people it does cause self reflection.

Subway doesn’t owe a duty to an employee’s wife. MAYBE in the case of occupational exposures, but that’s about it. I’m not sure why people are advocating that employers get more involved in the private lives of employees, which is behavior that this suit effectively encourages.

You’re tossing around legal terms that have no real applicability here. Subway is under no obligation to perform “due diligence.” They have no duty to investigate allegations of possibly criminal acts. They might have had an obligation to report child abuse that was known to them, but no one is saying that they knew

The issue is one of duty. No one is arguing that Subway did not have warning signs. But liability requires duty, and most states don’t impose a duty of care on employers to the spouses of employees. NJ courts have kind of done that, but only with regard to toxic exposure where the danger was more clear. But imposing
