They are legally in the right IF what they've sold is actually a product. If, however, they have been selling code that doesn't actually do anything, or have the potential to do anything, I'm pretty sure that cuts the legality of their venture out from under them.
Not everyone who uses the PC as a gaming platform is a power user. There are an increasing number who are just buying gaming capable kits and then running Steam on them. People who aren't going to feel comfortable tweaking anything that borders on system settings.
