Why would Marvel's Dracula have it's own copyright? Wouldn't they simply be using him publicly since Dracula's literature copyright has run out? I'm almost positive it must extend to cinema as well, but I can't really say.
Both Thor movies open with him on one of the Nine Worlds kicking ass with Sif and the Warriors 3 IIRC. Definitely Age of Ultron. It doesn't take long before Cap, Widow, and the STRIKE team are on that boat in Winter Soldier. The first Avengers kind of does, but maybe its not actiony enough.

Can they or can they not use Dracula? It seems like they should be able to, I know the novel is in public domain, but they seemed to try to avoid it in Blade Trinity and wasn't sure if that was for legal reasons or not.
