As a former employee of the NCDPS, this does not shock me. PO’s were vicious towards transgender offenders when it came to UDS observations and our policies reflected it.

It’s not diversion. For it to be a diversion program there would have to be a formal agreement brought before a judge stipulating certain criteria for the defendant to complete in order for the charges to be dropped.  The DA flat out dropped the case without prejudice and his record expunged. 

This is not a deferred prosecution.  They dropped the charges and expunged his record.
