I see your point, but think about this. If they can prove he wasn't driving, they would have to drop these charges. New charges could obviously come up as far as aiding and abetting.

Who was driving it isn't germane to his defense whatsoever. It's clear that he wasn't driving it and should be freed immediately.

You don't have to finger the allegedly guilty party in order to create reasonable doubt. This is an important tenet of our judicial system.

He's not required to say who was driving the vehicle. All he needs to prove is that it wasn't him driving the vehicle. People need to learn that laws and justice do not follow the "justice is fair" belief that many people have.
