It's not assault if the person is but a lowly server, from my experience. I've been assaulted multiple times (including sexually) while serving tables and nothing happened, except me crying in a bathroom stall, that is.

They make special high chair covers that I've seen parents use. I totally respect this practice even though the only place I worked in with high chairs actually sanitized them before and after EACH use. That is definitely NOT the norm, however, so keep that in mind at most places.
