With respect, I can’t help but think this is a false choice. First Amendment jurisprudence has long been very clear that while you cannot regulate speech based on content, you can regulate the conduct that accompanies that speech, for the very simple reason that conduct is not the same thing as speech.

Also as a white guy: doesn’t matter. The Constitution is there to protect the unpopular. That is its purpose. To protect from power.
