I don't know about other Countries, but in Canada maternity leave comes out of the Employment Insurance Fund (Federal government) so the employer is not paying women on maternity leave.
The fairest thing would be paternity leave for fathers as well. Neutralize it! Also, some women are more career-focused then their partners so it doesn't always make sense for the mother to take the maximum amount of time.
