Well the regulation is certainly flawed, but it is still the regulation.
Maybe they should just stop using diesel in cars until they can meet regulations...regulations that are actually not as strict as in gasoline engines.

The actual reason is for NVH. There is typically a bunch of sound deadening material under them. Sometimes they even cover mass dampers.
