I don't think he INTENDED to hit him either, but given his actions - he was careless, at best. Were you or I to hit or kill a pedestrian through our careless driving, we'd be charged with manslaughter. If they can prove that he goosed it right before hitting him - then we're talking about a 2nd degree murder charge.

I remember when Earnhardt died, and there was talk of cancelling the next race. I remember Stewart screaming loudly about how they should keep racing because Earnhardt's death wasn't worth making such a big deal about. It was insensitive, but he did have a valid point that cancelling the race wouldn't change anything.
