Exactement... it's not that they've skirted rules about what constituted TC when it was used before by inventing a new way of doing it... the concept of TC itself is what is banned, so anything that creates it is illegal.
The way the rules are written, there is no legal way to engineer TC into your car. TC as a concept is banned in all forms.
But all the engines, Renault, Mercedes, Ferrari and even Cosworth, use cylinder deactivation both for fuel conservation and torque curve control.
Because Red Bull has no reason to put it on Webber's car. Vettel is given a car that can win the race, whilst Webber's car is 'setup' to gain enough points that he doesn't become a nuisance to Vettel in the race, and that he takes a decent chunk of points off Vettel's rivals.
As Raph and others have noted above in the comments, Article 9.3 of the FIA F1 regs covers traction control, and forbids any system that acts as some form of traction control...
