Sure, if there’s something really bad in there, it could go to court-martial, but remember that the National Guard isn’t usually subject to UCMJ except on federal duty. There are state codes similar to UCMJ, but they are notoriously hard to get much done with.

Generally, the military discharge process in the absence of an actual crime is more administrative and not a court-martial. Being a MAGAt who thinks the election was fraudulent probably isn’t against the rules. A normal discharge can be pretty quick for a junior person, but the NG is notoriously a “good old boy”…

The Senate can’t take up the impeachment issue until January 20th, so they are trying to use some other leverage to get him out. The date of the impeachment isn’t really that critical now.

Congress does play a role in the 25th if the POTUS challenges the VP’s decision. They then have to approve the removal by 2/3rd vote in both houses, but they have 21 days to do so. They could stop the removal if they wished.

Mitch McConnell put out rules for the Senate side of the impeachment yesterday. The Senate can only reconvene before January 19th by unanimous consent — which isn’t happening.
