Unless I'm mistaken, you don't have to program for all of that when you make an app. The most you'll have to do is include different UI sizes for different resolutions.

Hummingbird is DRM capable, is it not? That's why TMO was able to put Avatar/Inception on their Galaxy S (and why it still works after a root/rom flash).

As long as the players aren't the ones committing the act (i.e., it's a story driven act like in Max Payne, for example), I don't see how it's any different from, say, television or movies.

Sounds like he's played ANY Blizzard game (Diablo II, Warcraft 3, etc., etc.)
