The theatre can’t foresee something like this, but didn’t someone mention that their faulty emergency door enabled his attack method? It’s not frivolous, it just wasn’t *enough* to find them liable.

As I read it, Cinemark didn’t have to file that request. They could have let those people pay their own legal bills and grieve without the spectre of more money than they’d probably make in a lifetime being owed.

While I agree that the theaters shouldn’t be liable and needn’t ramp up unnecessary security, Cinemark should be paying their own legal fees. This lawsuit was ill-advised at worst, certainly not malicious or frivolous, and these families who have already lost so much should not be footing the bill for a corporation…
