So you don't think tracking people who tweet about scandal, seeing who's tweeting who and rting who isn't proactive? it's essentially listening to a conversation to find out where someone lives so you can go to their house and rifle through that box of recordings.

I don't think the metaphor here is correct. Gathering phone call snippets out in the world requires a very pro-active behavior on the part of the recorder. The document must be made by the listener, even if it's capturing the speaker's behavior.

I get what you are saying, but Twitter is an open and public forum that is there specifically for people to read it! There is nothing, absolutely nothing private about Twitter.
