Well I think what you're arguing is the way it should be vs the way it is. I'm pretty sure the DA would not go for 2nd degree murder if he/she didn't think they could get the charges to stick. I think the key words you'll probably see are "implied malice" which has been used in the past in California to get 2nd degree

Currently its just original EQ and Kunark. They've been working on Velius forever but if they stop there I would never complain. As it is, the game is pretty fun. I enjoy it more than WoW thats for sure.
