While his price is a bit steep, why is the person a scumbag for trying to protected a copywritten image? He owns the rights to it and can reproduce it elsewhere if he so chooses, so are other artists that do the same considered scumbags in your eyes?

But they can turn around and tattoo the same image on someone else if they want, so there is a sense of ownership of the image. They obviously don't own the image on you, but they definitely can reproduce the image and protect it legally if they wish.

Showing the tattoo on TV is different. Recreating it in a video game can be seen as plagiarism. But, it's also a weird thing to ponder, because that person cannot help but look the way they do. So is it their likeness? Legally, that's up to the judge to decide.
