What almost certainly happened is that the restaurant chain was violating a state consumer protection law. A consumer protection lawyer took notice of it and started looking for a client to bring the lawsuit to get it enforced. Hence the delay.

This. It’s dumb for someone to sue over something like this, which is why big corporations can get away with predatory schemes. If this was a small mom and pop restaurant, it’d be one thing. But for a huge corporation with in house counsel to do it is another.
