Exactly, it may not be pirating, but using a Nintendo game in a way that wasn’t intended in a public setting where they’ll make profits off of the tournament is obviously not a good idea. They have every right to protect THEIR brand by preventing this sort of activity.

It sucks, but it’s also not that hard to understand why it happens. Project+ is not an official Nintendo made product and promoting it to the public, such as in a tournament, falsely makes it seem like a Nintendo product. There are legitimate reasons to protect your companies IP.

There is inspiration and building on top of the design of other works. Then there is straight up copying a design into your engine with a much larger team to make the exact same game but more polished.

If there’s an NDA and you agree to it, you should probably comply with the terms. If you don’t and it results in you being banned from using their product (if outlined in the terms), then that’s on you. What’s the big deal here?
