It could be even better for content creators if their pay from YouTube Red viewers is based on views and not on ads. After all, many ads can be skipped, so a content creator has to rely on ads that can't be skipped and on ads that viewers choose not to skip when it comes to free viewers.

Same way really, based on the number of views their videos had from subscribers during a set period of time.

The actual emulator itself is not illegal as it is a clean-room virtual machine.

Just wanted to mention that sometimes the real problem is the bios. The operating system of a console is as copyrighted as the games. For example you can freely download PSX and PS2 emulators but need to make a bios dump from your console yourself.

Even then the emulator itself isn’t illegal. Like how guns are legal but can be used to do something illegal. Some emulators are designed so that you still need a legitimate original disc or cartridge of the game. Even those can usually be exploited into recognizing ROMs though. Nintendo’s viewpoint is of course skewed towards IP protection and motivated by an extremely conservative Japanese company culture. I agree (and separately, US law agrees) with some but not all of what they say.

I’d like to point out that Nintendo is in fact, 100% wrong. You can play back TASes on 100% stock equipment. Standard NES, standard cart. The only thing non-stock is the machine pushing inputs through the controller port. See: AGDQ/SGDQ TAS blocks.
