To the best of my knowledge (I work in higher ed and have been through hours and hours of FERPA and TIX training), it doesn't matter whether she's suing for malpractice or for civil rights. As long as she's suing, it still falls under the exemption.

If you are injured (raped, assaulted, maimed, etc.) and then sue for damages, the defending party has the right to view medical records ehich would likely show the degree of injury (or lack thereof). If there are claims of pschycological injury mental health or counseling records…
