Also an attorney. The whole point of Epic’s lawsuit is that Apple’s TOS and payment systems are anti-competitive practices. So if they agree to continue going along with Apple’s policies, they don’t have damages and don’t have a case. They had to challenge Apple’s policies and get smacked down so they could show the

Depends on the lawsuit outcome I guess.

This is so on the button. I’m an attorney, Epic breached first and then (more or less) is saying the contract was so unfair they were forced to breach.

That almost NEVER goes well for the party that breaches, and trust me when I say that neither Epic nor Apple want the federal anti-monopoly guys sniffing around their

Epic is going to lose... epically. They are going to get kicked so hard in the nuts, their grandchildren will feel it.

What I find insane about this whole thing is that Epic does have a somewhat fair point in regards to the appstore monopoly but their chosen action as a multi-billion dollar company of manipulating kids and acting like a scrappy underdog make you want them to lose regardless.

You ever have two friends arguing with each other over something stupid, something so mundane and insignificant that you’re wondering what the hubbub is about? Then one or both of them turn to you and says, “tell em I’m right. He knows I’m right.” And you’re all, “don’t get me involved in your shit.”

Epic’s endgame is likely to force Apple to allow the Epic App store onto iPhones and iPads so they can take a (smaller, probably) cut of the in-app transactions, as well the entirety of Fortnite transactions.

My favorite spin on that was, “Thanks, Koch gaming!”

I’m actually kind of surprised it took this long for an ad agency to try something like this. The pieces have been there for quite a while.

If you’re shuffling creative directors around this far into development, you’re probably trying to salvage a disaster.

ok but can we keep lying to ourselves about that for another few months?

Uh oh.

Mobile issues are, I’m told, top of tech’s list atm, the redesign has not been kind to page speed or the ways ads are laid out.

Is there information on how much data a typical kotaku page uses? This page alone has 7 ads and an autoplaying video

I’ve put down Control for months by now, but I want to get it done now that AWE is coming soon. Maybe, I’ll even purchase Alan Wake to get the scoop on the story.

🎶Mike Fahey, spider-smashing hero! Hey, spidey spidey spidey, stay off of the pie! It’s his pizza pizza pizza so don’t make him cry!🎶

Been very exhausted lately from work. There will be more work this weekend too. My new desk should be getting here today, so when I’m not working this weekend, I’ll be taking my existing desk apart, moving it back into my studio, then setting the new desk up in the office, along with all the accouterments and such

Imagine suing a brick and mortar business for refusing to distribute your product for free.

As someone who works in the gaming industry, a 30% cut does suck. It only gets harder the smaller you are too. So part of me is like “Yeah, lower that amount!” But Epic isn’t small and I feel like this is going to get pretty ugly. I don’t really like the approach Epic is taking. They were definitely ready for this to

The whole 1984 angle and having all of this response prepared in advance really put a sour taste in my mouth. Trying to create this weird public discourse and use your arguably easily-influenced fan base to try and get what you want is...I mean, it’s on brand but it’s really gross. The extremely public and
