If that were true then the blocks would never activate if the hand didn't touch it yet you don't need to be straight beneath the block to activate it, in the picture you're showing if mario was a bit further to the right he would still be activating the block but the hand would be nowhere near it.

I'm going to bypass the whole argument that you're making some pretty wide assertions about the game without having played it (you're not a random dude but a trained combat pilot) and skip right to the point that what you're describing is a fairly regular plot element in myriads of video games and movies.

You may have an issue with my oversimplifying but it remains that piracy is theft. You are getting the benefit of enjoying the game but are not paying for it.
There is always the opportunity of waiting for the game to go on sale if you object to the price of games these days.
