HmmmmmMMMMmmm. I'm not really convinced at the reasoning. I think it is at least something that could be argued in court should Sony or Activision wish to do so. I mean it has "Destiny" right there in the text along with their logo, "XBox" and "order now". Perhaps if they had said "sounds like Dentistry" or something…
