You can’t keep them from using a name.  Trademark covers the use of it in titles and the like.  So DC hasn’t had a “Captain Marvel” book, but until pretty recently he was always referred to as Captain Marvel.

When I read the headline I thought Nathan Filion would be the person in question.  In the final seasons of Castle, things were so bad between him and Stana Katic that they didn’t even want to do scenes together.  I always assumed that Fillion had harassed her.

You also have Mel Gibson.  He built the height of his career around a series of movies where he would just get the shit kicked out of him before rallying to win the day. 

It’s a much smaller universe than the MCU, and, for good or bad, they kind of back doored into being a shared universe.  So they don’t seem as interested as Kevin Feige is in having this autocratic shared vision across all the films.

The “it was a different time” excuse doesn’t really fly because they were getting pushback at the time.  In the article they talk about protests from a real sorrority on the campus where they filmed over things like the spy camera scene.
