Having seen the pilot… yeah, it really wasn't very good.  The guy who plays not-Lucas Hood is a particularly weak link, and where Strike Back and Hunted had plot, the sex and violence in Banshee seem completely perfunctory.

Of course, Regina is also a rapist and murderer, and I'm sure you could whip up some fairly serious charges from the whole curse casting thing.  Frankly, if we were being realistic about adoption issues, Regina would have had her custody rights revoked ages ago. And then she would've been arrested and given the needle.
