A basic rule of the road requires a vehicle to be able to stop safely if traffic is stopped ahead of it. If it cannot stop safely, the driver is not driving as safely as the person in front.

Driving a sports car? definitely passing, you can almost see his intentions to get into the left but instead decides he doesnt want to be behind mr slow DWI in the left, so he passes on the right.
how do we know he is travelling the speed limit? He just merged off of an entrance ramp, and other traffic appears to be traveling faster than 55 or 65 (assuming this occurred in NY)

As a seasoned I75 veteran, I know the situation well. Honestly, between Sarasota and Tampa, the middle is usually the slowest, right is the fastest and left is a crap shoot.
Most definitely, however mr DWI appears to notice he is in the wrong by left lane cruising and trying to fix said issue, forgetting to check his blind spots before moving in.
