Actually, in most states that have “Romeo and Juliet” laws, the scenario you described is still a crime. “Romeo and Juliet” laws typically don’t decriminalize the action, they just reduce the penalties. For example it may be a misdemeanor rather than a felony, or no longer involve mandatory sex offender registration.
