I don't think it's in the EULA. I think Gabe himself said it. And I don't know how effective it is to sue for such a thing. When former music DRM services went down (such as Walmart's), I don't think people could do anything, and lost whatever music they had bought.

Xenoblade Chronicles sold under a million copies. Bayonetta sold 2 million, and most of those after a major price drop. Most Dynasty Warrior games don't pass a million, and none have done so last generation. X, Bayonetta 2, and Hyrule Warriors combined is not even going to add much to Wii U sales.
